If either you or your Employer do not agree with the decision of the Employment Relations Authority , the decision may be appealed by your union on your behalf to the Employment Court.
Not every case is appealed to the Court. Your union would need to talk through with you the merits of taking an appeal, and weigh up whether this step should be taken.
A judge of the Employment Court will hear the case. For very serious problems that may involve a change in the way the law operates, the full Employment Court will hear the case. The Employment Court operates like other courts, with witnesses giving evidence before the judge. After hearing and considering all the evidence, the judge will make a final decision on the problem.
